'Murder not premeditated': HC modifies sentence

Ahmedabad: The Gujarat high court commuted the life term of a murder convict to 10 years of imprisonment while observing that it was not a premeditated act.
The Surat trial court had awarded the sentence to accused appellant Sursing Bamne under IPC section 302. However, HC modified the conviction to section 304 part II.
The seventh division bench of justice Abhilasha Kumari and justice AJ Shastri, while partly allowing Bamne's appeal, concluded, "The act of the appellant accused was not premeditated and there was no intention on his part to kill the deceased or cause bodily injury."
