Revealed: How top cop Jain pulled off the Dara encounter

CBI charge sheet reveals how ADG AK Jain not only misled the then DGP AS Gill but also violated procedure and practice showing undue haste in declaring reward on Dara Singh

The Central Bureau of Investigation (CBI) has got some strong statements from the police officers that put their colleague additional director general of police (ADG) AK Jain in dock.
Jain, one of the main accused in alleged fake encounter of Dara Singh alias Daria has been absconding ever since his name was included in the CBI charge sheet and seeking anticipatory bail but the statements of police officers from top to bottom do not help his cause.
According to these statements Jain not only misled his superior then director general of police (DGP) AS Gill but also violated procedure and practice while showing undue haste in declaring reward on Dara Singh.

Former DGP AS Gill: Although he admitted that reward on Dara Singh had his approval as he believed the noting put up by Jain vide para 5/N that accused Dara Singh was involved in cases of murder, dacoity and abduction but claimed that he was misled by Jain.
“Had I come to know these facts on October 18, 2006 (about cases against Dara), I would have certainly not approved declaration of reward of `25,000 on Dara Singh. I had been misled by AK Jain in this regard.”
“He (Jain) also noted in his hand to ‘issue today’ generally there is no urgency or hurry in the matter of declaration of rewards. I see that file has moved at a break neck speed” which shows there was some urgency in getting the reward declared on Dara Singh. Only AK Jain can explain the urgency in declaration of reward Dara Singh on a letter received five months ago in connection with some other matter”
“I am not aware who ordered Special Operations Group (SOG) to go after Dara Singh. SOG was under the charge of AK Jain, ADG (Crime) and I had not directed either AK Jain or A Ponnuchamy, SP to take action against Dara Singh. I do not understand the reason why a copy of this reward order was sent to SOG by fax when SOG had not been directed to act against Dara Singh.
“I had not directed A K Jain and A Ponnuchamy to intercept any phone in order to facilitate the arrest of Dara Singh.”
“It was not the duty of SOG to arrest the accused involved in liquor smuggling. ….The work of SOG is mainly to go after terrorists and big organized criminals.”
“I had marked the letter and petition for enquiry to AK Jain (regarding allegation of fake encounter of Dara). He did not put up the aforesaid file to me thereafter and no enquiry report was brought before me at any time. AK Jain ought to have put up the file to me.”
ADG (ACB) Ajit Singh: “I can not say about the hurry by ADGP AK Jain that he had to write in his note that order had to be issued the same day.”
“ADGP saheb’s note on para 5/N does not match with the information sent by SP Churu. In his note Jain sahib had stated that Dara Singh had a murder case against him. Only he can tell as to why did he write this? Dara Singh had no case under the IPC 302 as per the information sent by SP Churu.”
IGP (vigilance and CM Security), Saurabh Srivastava: It is seen that the ADGP (Crime) AK Jain had recommended reward of `25,000 on Dara Singh and no reward on Kalyan Singh. The DGP had ordered that for the other declare ` 2000. However, the DGP had not mentioned anything specifically about Dara Singh Dara Singh whereas ADGP (Crime) had mentioned about declaration of reward of `25,000 on Dara Singh. I am not aware whether anything had transpired between DGP and ADGP while recording the note by ADGP.”
Former SP, Govardhan Lal Meena: He was posted as SP (Human rights & weaker sections) with additional charge of SP (Admn & PRC). “On being asked, I state that any criminal against whom neither any case has been registered nor any verifiable information regarding his committing any crime has been received in last 20 months can not be declared as hard core criminal.”
“Immediately prior to said ASI of PRC section coming to me, I had received inrtercom from the then ADG (Crime) AK Jain who told me that he is sending one file through ASI of PRC and directed me to quickly send the file to him through proper channel.”
“I state that it has been wrongly mentioned in the notesheet that offence of murder was also committed by Dara Singh. …I confirm that the copy of that reward was not endorsed to SP, SOG, Jaipur.”
DIG Training, Hari Ram Meena: He was SP Churu from June 2005 to April 2007.
“On being asked, I inform that Dara Singh was involved in many crimes, however, I did not announce reward for his arrest as I deemed it not appropriate to declare reward against him. I also did not send any proposal to IG Range.”
“My office received the order of reward on Dara Singh through fax on the morning of October 19, 2006. The same order was received through post on October 30, 2006. Meanwhile, on October 23, 2006 it was known that Dara Singh was killed in police encounter. I can not say if hurry in declaring reward on Dara Singh has any relation with his encounter.”
SI (CID ,CB) Virendra Pal Singh: “On October 17, 2006 around 10.30/11 am then ADGP (Crime) AK Jain called me and asked to bring the letter of SP Churu about reward on Dara Singh.”
“When, I presented letters from the SP and SP Administration & PRC, ADGP scolded me for not putting up these letters before (Itne dino se inko kyo patak rakha hai). He then told me to put up the letter immediately.”
“ADGP sahib asked me to run and tell the officers that he had asked for the file immediately. (Daudkar lekar aao aur kaho ki maine ye file abhi mangwai hai).”
